5. Hinweisgebersystem

Bei der Abgabe einer Meldung werden personenbezogene Daten (z.B. Name, Kontaktdaten, Fotos, gemeldeter Sachverhalt etc.)

  • der Person, die eine Meldung abgibt (hinweisgebende Person)
  • der von einer Meldung betroffenen Person (gemeldete Person)
  • und der sonstigen, in einer Meldung genannten Personen (z.B. Zeugen und/Dritte)

die in das Meldeformular eingetragen werden, verarbeitet.

Zweck und Rechtsgrundlage

Die vorgenannten Daten werden zum Zweck der Aufdeckung und Verhinderung schwerwiegender Missstände sowie zur Vermeidung und Abwehr besonders einschneidender oder existenzbedrohender Rechtsfolgen und Schäden sowohl für unsere Organisation (Strafverfolgung, Schadensersatzforderungen, Imageschäden, aufsichtsrechtliche Maßnahmen) als auch für unsere Mitarbeiterinnen und Mitarbeiter verarbeitet.

Rechtsgrundlage für die Verarbeitung ist Erfüllung einer rechtlichen Verpflichtung gemäß Art. 6 Abs 1 lit c DSGVO i.V.m. § 10 HinSchG.

Empfänger

Zugriff auf die Meldungen haben ausschließlich fachlich qualifizierte Mitarbeitende der KATAG AG. Ihre Identität wird uns von dieser nur in den gesetzlich geregelten Fällen offengelegt.

 

Im Rahmen der Prüfungen, Untersuchungen und zu treffenden Abhilfemaßnahmen kann es erforderlich sein, Informationen zu einem gemeldeten Vorfall an externe Berater (z.B. juristische Berater) oder an die zuständigen Behörden zu übermitteln.

Die Infrastruktur des Systems, einschließlich Webseiten und Datenbank, wird von der Modehaus GmbH in unserem Auftrag nach Art. 28 DSGVO betrieben, die wiederum spezialisierten Softwaredienstleister als Unterunterauftragnehmer einsetzt. Die KATAG AG ist zu strikter Vertraulichkeit und zur Einhaltung sämtlicher datenschutzrechtlicher Anforderungen verpflichtet.

Speicherdauer

Personenbezogene Daten werden so lange aufbewahrt, wie es die Aufklärung und abschließende Beurteilung erfordert oder dies aufgrund eines Gesetzes erforderlich ist. Die Hinweise und Meldungen werden entsprechend der gesetzlichen Vorgaben 3 Jahre nach Abschluss des Verfahrens gelöscht.

Externe Meldestellen

Das Hinweisgeberschutzgesetz räumt Personen, die beabsichtigen, einen Hinweis abzugeben ein Wahlrecht ein, ob sie sich an eine unternehmensinterne Meldestelle wenden oder eine externe Meldestelle das Bundes oder der Länder anrufen. 

Nach dem Hinweisgeberschutzgesetz soll aber auch Meldungen an eine interne Stelle der Vorzug gegeben werden, wenn über diese Stelle eine wirksame Bekämpfung des Verstoßes möglich ist und die Hinweisgeber keine Repressalien zu befürchten haben (§ 7 Abs. 1 HinSchG).

Wir gehen allen Hinweisen auf Verstöße, die über den notwendigen, beruflichen Zusammenhang mit unserem Unternehmen verfügen, nach. Wir verpflichten uns ausdrücklich, Hinweisgeber vor Repressalien zu schützen.

Externe Meldestellen des Bundes sind aktuell eingerichtet 

  • beim Bundesamt für Justiz
  • bei der Bundesanstalt für Finanzdienstleistungsaufsicht und
  • beim Bundeskartellamt.
